When is a Development Application (DA) Required?
Before making changes to your home or business premises, you may need to lodge a Development Application (DA). Development Applications are required for the following:
- Constructing a new dwelling house, commercial or industrial building
- Alterations and additions to an existing house
- Subdividing land
- Changing the use of a building (cafe, restaurant, gym etc)
It’s important to note that Council cannot grant approval after work has already started or been completed without the required permissions, therefore it is always encouraged to undertake the most suitable approval pathway prior to any constructions works commencing.
Preliminary Planning Report
It can often be tricky to identify if a Development Application is required, for this reason we have development something called a Preliminary Planning Report (PPR). This report assess your proposed development against all of the planning controls and identifies if a DA is required, it also determines the likelihood of obtaining approval for your project.
Waverley Local Environmental Plan (LEP) 2012
The LEP is a statutory document that sets the legal framework for land use and development. It includes zoning, building heights, floor space ratio requirements, tree protections, heritage overlays. It was developed in consultation with the community and approved by the NSW Minister for Planning. It is crucial the any application that is lodged assess and justifies compliance with the LEP, this is a state based requirement for all types of development. A Statement of Environmental Effects (SEE) is where this justification takes place, all Development Applications are required to submit and SEE with their Development Application.
Waverley Development Control Plan (DCP) 2022
The DCP provides detailed design and planning guidance to support the LEP. It’s not legally binding but is used to assess development proposals under Section 4.15 of the Environmental Planning and Assessment Act.
The DCP covers topics like:
- Setbacks, building planes, solar access and privacy issues that may arise
- Landscaping, pools and outdoor structures
- Commercial development and outdoor dining
- Streetscape and infrastructure
Within the Statement of Environmental Effects (SEE) it is important to identify and determine compliance of these controls. Planna provides a comprehensive SEE that addresses all of the matters and requirements within LEP and DCP leading to a higher probability of approval.
